By using my portfolio website, you agree to the following terms governing both site usage and freelance project engagements.
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and me concerning your access to and use of my website. By accessing the Site, you agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use the Site.
Unless otherwise indicated, this portfolio website is my proprietary property and all source code, designs, text, and graphics on the Site are owned or controlled by me and protected by copyright and trademark laws. You are granted a limited license to access and use the Site for your personal, non-commercial use only.
For freelance project deliverables, all source code, frameworks, and underlying technology I develop remain my intellectual property. Source code is not provided, transferred, or licensed to the client. Upon full payment of all agreed fees, the client receives a non-exclusive, non-transferable, revocable license to use the delivered website or web application for its intended business purpose. If the project includes a content management system, the client is granted admin-level access to manage their own content. This is a usage right and does not constitute ownership of the underlying software.
All freelance project engagements are governed by a separate written agreement (proposal / statement of work) agreed upon prior to commencement. That agreement defines the specific scope, deliverables, milestones, timeline, and fees for the project. In the absence of a signed contract, these Terms serve as the baseline understanding.
The deliverable is a live website or web application, not source code. I provide admin and/or CMS access so the client can manage their own content where applicable.
Domain ownership— If I purchase the domain on behalf of the client, I hold registration and management rights unless otherwise agreed. If the client already owns a domain, I will assist in configuring it to point to the delivered site.
Project fees, milestones, and payment schedules are defined per project proposal. Invoices are due within the period stated on the invoice.
Recurring fees— Ongoing hosting, maintenance, and continued access to the delivered website or application are subject to a recurring fee (monthly or yearly) as defined in the project proposal. This covers server maintenance, security updates, and technical support.
Late payment— Late payments may result in work being paused until the outstanding balance is settled. If a recurring fee remains unpaid for 30 days past the due date, I reserve the right to suspend or take the site offline after providing written notice.
I reserve the right to display completed project work in my portfolio, including on this website, unless you request confidentiality in writing prior to the start of the project. Trade secrets and proprietary business logic will not be disclosed.
The Site may contain links to third-party websites. Such Third-Party Websites are not investigated, monitored, or checked for accuracy by me, and I am not responsible for any Third-Party Websites accessed through the Site. Any purchases you make through Third-Party Websites are exclusively between you and the applicable third party.
By using the Site, you agree to be bound by my Privacy Policy posted on the Site, which is incorporated into these Terms of Service.
These Terms shall remain in full force and effect while you use the Site. I reserve the right to deny access to the Site to any person for any reason, including for breach of any representation, warranty, or covenant contained in these Terms.
Project-specific engagements may be terminated by either party with written notice as specified in the project agreement. Upon termination, the client may request a data export of their content within 30 days. The delivered site may be taken down following the 30-day non-payment notice period as described in Payment Terms.
These Terms shall be governed by and defined following the laws of India. You and I irrevocably consent that the courts of India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, I DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF. I MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SITE’S CONTENT.
IN NO EVENT WILL I BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF I HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FOR FREELANCE PROJECT ENGAGEMENTS, MY TOTAL LIABILITY IS LIMITED TO THE TOTAL FEES PAID FOR THE SPECIFIC PROJECT IN QUESTION.
You agree to defend, indemnify, and hold me harmless from and against any loss, damage, liability, claim, or demand arising out of your use of the Site, your breach of these Terms, or your violation of any rights of a third party.
